New Mexico--Laws Relating to Pregnancy

Prohibitions against Pregnancy Discrimination

It is unlawful to discriminate based on sex. Sex discrimination includes discrimination based on pregnancy, childbirth, or related medical conditions.

Pregnancy Accommodation

New Mexico does not provide additional protections to the federal law, but see below regarding Disability Accomodation. For the text of the statute, click here.[2]

Pregnancy-Related Disability Accommodation

Employers must treat pregnant workers as they treat temporarily disabled workers.

Breastfeeding Rights

A mother may breastfeed her child in any public or private location where she is otherwise authorized to be.

Employers must provide a clean, private place, not a bathroom, for employees who are breastfeeding to pump. Break times are not required to be paid.

Family and Childcare Leave Laws

Public sector employees may use sick leave to care for family members.
