Prohibitions against Pregnancy Discrimination

It is an unlawful employment practice to discriminate based on sex. “Because of sex” includes because of pregnancy, childbirth, or related medical conditions.

Pregnancy Accommodation

Nebraska does not provide additional protections to the federal law.

Pregnancy-related Disability Accommodation

Nebraska does not specifically accommodate pregnancy or its attendant medical conditions as a disability.

Breastfeeding Rights

A mother may breastfeed her child in any public or private location where the mother is otherwise authorized to be. It is unclear whether this authorization extends to a woman’s place of employment.

Family and Childcare Leave Laws

Women affected by pregnancy, childbirth, or related medical conditions must be treated the same for all employment-related purposes, including receipt of employee benefits, as other persons not so affected but similar in their ability or inability to work.
