Prohibitions against Pregnancy Discrimination

It is an unlawful discriminatory practice to discriminate based on sex. Sex includes pregnancy and medical conditions which result from pregnancy.

Pregnancy Accommodation

New Hampshire does not provide additional protections to the federal law.

Pregnancy-related Disability Accommodation

New Hampshire does not specifically accommodate pregnancy or its attendant medical conditions as a disability.

Breastfeeding Rights

Breastfeeding does not constitute indecent exposure. Limiting or restricting a mother's right to breastfeed is discriminatory.

Family and Childcare Leave Laws

An employer must permit a female employee to take a leave of absence for the period of temporary physical disability resulting from pregnancy, childbirth or related medical conditions. Leave is job-protected.

For all other employment related purposes, including receipt of benefits, pregnancy, childbirth, and related medical conditions are considered temporary disabilities.

Employees who lose their jobs due to an ill or disabled immediate family member may still be eligible for unemployment benefits.
